By accessing or using TokuClub's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access our services. These Terms apply to all visitors, users, merchants, and others who access or use the Service.

2. Description of Service

TokuClub provides a cloud-based loyalty and customer engagement platform ("Service") that enables merchants to create and manage customer loyalty programs, track points, offer rewards, and analyze customer behavior. The Service includes web-based dashboards, customer portals, and API access depending on your subscription tier.

3. User Accounts

3.1 Account Creation

To use our Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account or any other breach of security.

4. Subscription and Payment

4.1 Subscription Tiers

TokuClub offers various subscription tiers (Lite, Standard, Pro, Elite) with different features and pricing. Features and limits are subject to your selected subscription tier.

4.2 Trial Period

New accounts may be eligible for a 14-day free trial. After the trial period, you must subscribe to a paid plan to continue using the Service.

4.3 Billing

Subscription fees are billed monthly in advance. All fees are non-refundable except as expressly set forth in these Terms. We reserve the right to change our pricing with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any malicious code or attempt to interfere with the Service
• Collect or store personal data without proper consent
• Use the Service for any fraudulent or deceptive purposes
• Resell or redistribute the Service without authorization
• Attempt to gain unauthorized access to any systems or networks

6. Data and Content

You retain all rights to your data. By using the Service, you grant us a license to host, store, and process your data solely for the purpose of providing the Service.

You are solely responsible for the data you collect from your customers through our platform. You must comply with all applicable data protection laws and obtain proper consent from your customers.

The Service, including its original content, features, and functionality, is owned by TokuClub and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks may not be used without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, TokuClub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will cease immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Jakarta, Indonesia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
